Since the judge found for Diskeeper on its motion to strike Godelman and Le Shay's request in their complaint for injunctive relief barring Diskeeper from using Hubbard Admin Tech, Diskeeper has moved for summary judgment (summary judgment basically means that even if the facts in the complaint are accepted as true, plaintiff still has no claim as a matter of law), and now Godelman and Le Shay have filed replies opposing Diskeeper's summary judgment motion. If the judge finds for Diskeeper's summary judgment motion, the case is over (but could be appealed); if the judge rules against it, the case goes to trial.

The last few months have also seen a great deal of motion practice on the issue of keeping one particular document confidential—that being the Diskeeper Company Handbook. Godelman / Le Shay won this particular battle, however, and the lengthy document is contained in a Declaration by attorney Barry Kaufman, which can be viewed here:

The Diskeeper Company Handbook can be found on pages 121-169 of the Kaufman Declaration. Before you even read a word of the Handbook, you know that something is very Scientologyish about it—largely because it’s mostly comprised of what appear in form to be HCO PLs—except that they’re actually “Executive Software International Policy Directives” (ESI PLs), and they’re written not by L Ron Hubbard, but Craig Jensen, and each ESI PL refers back to specific HCO PLs and other Scientology literature. But what’s striking is how Jensen followed Hubbard’s format and tone in creating the ESI PLs.

If you were already inclined to believe that Diskeeper was being run no differently than Scientology, the content of the Handbook won’t do much to dissuade. There’s an interesting section discussing the e-meter (e.g., “It is legal for Executive Software to make use of the E-Meter in its business environment” the Handbook hopefully postulates); it adopts The Way to Happiness as Executive Software’s official “moral code”; and it states that Executive Software’s goals include:

To get computerized LRH administrative technology really in use raising the production of the people of Earth, individually and organizationally, up above the make-break point and into a range where everyone can flourish and prosper, setting standards for future generations and civilizations to come.

There’s also a interesting admission that some “tolerance” would be required of employee to see beyond “religious terms”:

Projects are under way by others to secularize the Hubbard Administrative Technology and, as these materials become available, we will use them. In the meantime, some interpretation and adaptation is needed as well as some tolerance of and willingness to see beyond the religious terms and examples.

And of course, there’s a ton of obligatory Scientology jargon, so much so that there’s even a glossary section, which includes definitions for “condition formula,” “tone level,” and “clear.”

It becomes obvious rather quickly why Diskeeper didn’t want their Company Handbook making its way to the internet … and yet make its way it did (to remind, page 121-169 in http://www.filedropper.com/kaufmandeclaration).

There are other great documents, not all of which I’ve obtained (there’s been a ton of paper filed in this case, and the LA County website charges by the page). One of those documents is a declaration by Alan Cartwright (http://www.filedropper.com/alancartwrightdeclaration), who is Assistant Secretary of CSI, and who essentially authenticates material used by Diskeeper as ‘scriptural’.

Didn't a federal judge require that all e-meters be labeled as "for entertainment purposes only" not that quote but something similar.

But Scientology does claim the E-meter as a "religious releck". - sorry can't spell releck tonight.

In this case the label doesn't matter. Outside of certain Federal organizations, it's a violation of Federal, and most State's, law to make submitting to a lie detector test (however crude) a condition of employment.

Does this mean employers can use parts of the Bible that don't mention God, e.g., no "unclean" food allowed on the premises, as part of their Employee Handbooks, and inforce it? Any bets on how long it would take the ACLU to be all over that?

To me, this idea that something El Ron's wrote can be "scripture" and "secular" at the same time is a big red flag the whole thing is a scam.

The first thing that pops out at me about the Employee handbook is that it is labeled Confidential. I've work at several companies over the years and none have had "Confidential" Employee Handbooks.

I think, but am not sure, that it was only labeled 'confidential' in connection with this litigation. As I mentioned, Diskeeper put up quite a fight to keep it sealed in the court record, to no avail.

I don't know if this information has already been told, but for those that don't already know, Craig Jensen and his wife Sally are both EX Guardian Office staff.

Craig once held the post (job) or Deputy Guardian Legal US. DGLUS was THE top post in the US for all legal cases that Scn was involved with.

Sally Jensen, was the Deputy Guardian Social Coordination US. Social Coordination is now known as ABLE. The DGSCUS was responsible for running all the front groups that use LRH tek.

Date wise, I'd say this was mid seventies until the early 80's when the GO was replaced with OSA.

The Jensen's were and are both major players and major financial contributors to the cult.
