US Gov't says foreign Sea Org entitled to Minimum Wage

The US Government just issued this overview of the rights of foreign workers while working in the USA. This should include foreign Sea Org employees.

This document also covers the basics of Labor Trafficking (a form of Human Trafficking).

Your Rights Regardless of Visa Status

There are also many rights you have regardless of your visa status. If any of these rights are violated, you can report the violations to a government enforcement agency. In most cases, you can also bring a lawsuit to attempt to recover your losses, without fear of being punished.

1. Your Right Not to Be Retaliated Against

It is unlawful for your employer to try to punish you, for example, by threatening to report you to immigration or the police if you try to enforce your rights! If your employer threatens you at any time, seek help immediately. Remember, your safety comes first!

2. The Right to Be Paid

You have the right to get paid for all work you do, in the same manner as U.S. workers.

You have the right to earn at least the federal legal minimum wage $6.55 per hour, and $7.25 per hour starting on July 24, 2009, in the same manner as U.S. workers. Also check the minimum wage for the state in which you work. If that wage is higher, you have the right to be paid the higher amount.

Your employment contract, which may obligate your employer to pay a higher amount.

Most workers in the United States are entitled to overtime pay of one and a half times the amount of their wage for any hours worked over 40 hours per week. For example, if your regular wage rate is $10 per hour, your employer may be required to pay you $15 for each hour you work above 40 hours in a single week.

If your employer takes money from your paycheck, this is called a deduction. Many deductions are illegal if they diminish your legal wage rate. For example, an employer usually may not deduct for housing (with some visa classifications, housing must be provided free of charge), most uniforms, safety equipment, or recruitment fees.

Because I'm a lazy drunkard and the document is tl;dr....can anyone tell if this applies to 'religious workers' as the Scilons always claim? I'm no lawfag but it seems that the Scilons usually claim this religious exception, so not sure this applies?

I know...lurk more and all that shit. But I'm lazy and a drunkard so I'm hoping someone just tells me.

S.O. can always get their workers to sign documents saying they are waiving minimum wage. And they probably will, so use it against them and play the human rights angle.

Sorry, that argument won't work anymore. Scientology says Sea Org are employees with legally binding employment contracts.

While CSI and the Churches of Scientology only employ religious workers with appropriate qualifications in bona fide positions, and while CSI is clearly a legitimate organization so it is unconcerned with proving that, CSI sees some potential for problems with the regulation as proposed.

They may not be able to. Their are some agreements that cannot be signed away. I believe they are called torts in UK/Australian Law. Not sure about USA though, but their are certain types of agreement that have no legal basis.

I know in Australia they have signs outside supermarkets to say if you go into this store you consent to a bag search. If you refuse however, the legislation that covers your privacy takes precedence and they really don't have a right to.

In this instance, it would be very unwise for them to get them to sign agreements like this as the only use they could possibly have is as evidence that they had been contravening the law.

If they are outside of the US it might be very difficult to police though.
