The Church of Scientology, bristling from public criticism by a nationally recognized psychiatrist and UCLA professor, has sued the outspoken educator and the university.

In a lawsuit filed this week in Santa Monica Superior Court, two student followers of the controversial church claim that Dr. Louis J. West has waged a smear campaign of religious intolerance and hatred on university time.

The verbal attacks by a representative of the state university system and his alleged “anti-religious activity” are violations of state law and education code, they say.

No way, West responded Friday. “This is a free country.”

West, 68, a professor of psychiatry and behavioral sciences, said he feels “fully justified” in speaking out against the church and its founder’s “so called science,” which West described as pure “science fiction.”

“My concern is not their doctrine,” West said, “but only the harm I see they have done to people.”

The Church of Scientology, which was founded in 1954 by the late science fiction writer L. Ron Hubbard, is a religion “in the most traditional sense,” which helps deal with man as a spirit and help him “shed the trauma and guilt (sin) which encumber him,” according to its printed catechism.

Adherents of mainstream religions have labeled it a cult, however, and accuse its leaders of using brainwashing techniques to ensnare the gullible and ensure unquestioned devotion from its flock.

“As a physician, my job is to take care of the sick and call attention to the environmental factors that contributed to their symptoms,” West said.

“If I see cults, like the Church of Scientology… operating in such a way so that people come to harm,” he added, “then as a physician and an educator, it is my duty to say something about it, and to communicate those ideas… to the public.”

The church calls the psychiatrist’s verbal attacks a violation of both the US Constitution and state statutes. Such religious persecution is against the law, church leaders say. And taxpayers are paying a hefty price for it, they say.

West, whose salary is paid by the state of California, wastes no opportunity to sling mud at the Scientologists, said Linda Simmons Hight, a spokeswoman for the Los Angeles-based church.

In a speech the doctor gave in November in Westchestor, for instance, he compared Hubbard to Adolf Hitler, she said.

In effect, the university system is “subsidizing his attacks on religion” by paying him a salary while he’s engaged in inflammatory conduct and activities intended to fan the flames of public fears about supposedly “dangerous groups,” she said.

“Where does it come off that it’s OK for the state of California to support someone who attacks new religious movements, where no one would give it a second thought to tell him to knock it off if he were attacking Jews or Catholics?” she asked.

Kendrick L. Moxon, the attorney who filed the lawsuit Wednesday on behalf of UCLA students John Van Dyke and Mario Majorski, said “major First Amendment concerns” are at stake. It is illegal to discriminate against someone because of race, sex or religion.

The suit seeks both preliminary and permanent injunction against all parties to prevent further support of any anti-religious activities.

The students charged that West used his credentials as a professor at the school to help organize conferences and seminars against CAN's targeted list of religions and attacked these groups in speeches, while getting UCLA to pay his expenses. These included conversations in 1985, 1988, 1989, 1991 and 1992. West, according to the suit, has also been involved in soliciting donations for CAN.

The suit also delineates West's role -- while on the UCLA payroll -- as a deprogrammer of an adherent of Sufism (a form of Islam) who in late 1991 was held captive in a remote cabin in Scotland. West's partner, CAN deprogrammer Joseph Szimhart, has since been arrested in the U.S. and is awaiting trial for a kidnapping he participated in just after returning from working with West in Scotland.

Magorski noted that this is not the first time that West's activities have been the subject of controversy. In 1973 West came under heavy fire for his plans to establish a "Violence Center" at UCLA which would use chemical castration, psychosurgery and early childhood testing against African-Americans for social control. West's plans generated national protests, triggered by student demonstrations on the UCLA campus.

In 1989 West was replaced as the head of the UCLA Neuropsychiatric Institute at UCLA, a position he held for 20 years.

The suit was filed in the United States District Court for the Central District of California.

Two UCLA extension students in the Chruch of Scientology have filed suit against UCLA professor Louis Jolyon West, the Board of Regents and Chancellor Charles Young for allegedly using taxpayer money to fund anti-religious activities.

The university has yet to respond to the suit filed last month with the Santa Monica Superior Court.

John Van Dyke and Mario Majorski charge that, while on University of California payroll, West used his position to organize anti-religious seminars and two groups that target minority religions – Cult Awareness Network and American Family Foundation.

“I saw him on TV in this program and he said some things about other people’s religions and he was attacking them,” said Van Dyke, who is now a senior marketing major taking classes at Cal Poly Pomona while planning to enroll in more classes at UCLA. “That’s where I drew the line. It really touched my heart that someone was actually getting away with that.”

But West counters that the church practices a severe form of mind control, drawing up contracts for members to work for the church in this life – and often in their afterlife.

“There are enormous pressures for its members to stay,” West said. “Anyone who wants to leave is threatened. They’re very harsh and demanding and uncompromising.”

He also says the church uses amateur psychotherapy that has left its members physically and mentally damaged.

“It’s like amateurs doing surgery,” West added. “There’s mental damage. They’ve been depressed, frightened, fearful, have eating disorders, impaired sleep, loss of confidence and an inability to exercise individual thought.”

The charges include that UCLA co-sponsored conferences that allegedly attack scientology (sic), that West made derogatory remarks about scientology at a Washington, DC conference and that he violated the California Education Code.

“It’s despicable conduct, but if it is on his own time and he’s not spending taxpayer’s dollars, it would not be implicating the university or Board of Regents,” said Linda Simmons Hight, a public information officer with the church. “He represents himself as a UCLA profressor, so it puts it in [scan cut off]

My main concern is situations that put people in harm’s way.”

The Church of Scientology was founded in 1954 on the teachings of the late science fiction writer and author of Dianetics, L. Ron Hubbard.

The church deals with the growth and change of the human spirit to help a person improve and better communicate with family and friends. It is also very active in drug rehabilitation and other community service efforts, said Hight.

However, West says their form of drug rehabilitations, called “Purif” for purification, entails making the addict sit in daily saunas for extended periods of time while taking vitamins that leave the patient chemically imbalanced.

West said he is bothered by the charges. Known as an outspoken critic of the scientology church, West says the church emulates Hubbard and teaches lessons based on his fictional stories.

“I’m a person who has spent most of his life trying to help people and I don’t like being represented as a person of ill will,” he added. “I would never try to deprive someone of his or her religion, but when people claim a religious rationale for doing evil things, then that’s not a bona fide religion.”

This suit is the second attempt by students to bring an injunction against West. A similar case filed last June in the United States District Court was thrown out in March.

The first case was dismissed in March because the students did not have the grounds as taxpayers to sue West, and did not provide facts suggesting that the university’s subsidization of West’s activities were malicious.

In addition, the court held that stopping West from speaking out would violate West’s free-speech rights. [rest of scan cut off]

Your article “Church Members File Suit Against Professor,” May 17, quotes psychiatrist Louis Jolyon West, at length but is less generous with the quotations from reporter Nancy Hsu’s interview with me.

West seems to think that free speech means that he is free to break laws and misuse state funds to conduct his personal vendettas. He is wrong.

West is a victim of his own prejudices and misconceptions. Substitute “Jews” or “blacks” for “Scientologists” in West’s remarks and the outrage would be thundering. He would be denounced as a racist or anti-Semite and probably toppled from his post at UCLA.

The suit ahs been brought because West’s diatribes against Scientology are being supported financially by UCLA and the Board of Regents (who do so with the monies of California taxpayers and tuition payers) in violation of the constitution and education codes.

West’s track record on human rights indicates that he has pushed for measures which discriminate against minority, ethnic, racial and religious groups. In the 1970s, he ran into controversy with a proposed “experimental violence center.” Chemical castration and implanting electrodes into people’s brains were among the plans he put forward. Young black males and Latinos were to be most of the guinea pigs. There was a public outcry, and the proposal was abandoned.

In the 1950s he took part in “mind control” experiments funded by the CIA, he advocates mind-altering drug use to “cure” violence, and he has stated that “morphine, heroin and synthetic narcotics” may become “prescription drugs in psychiatry.”

He also has the dubious distinction of being the first psychiatrist to kill an elephant with LSD. The animal died in agony after he injected it with a dose of the drug large enough to send 1,400 humans on full-blown trips.

Background on Jolyon West

- First heard about Scientology during the Dianetics Foundation days (early 1950s), thought it was stupid, and said so

- Pwned an elephant in the 1960s by shooting it with a tranquilizer dart full of LSD. srsly

- Published a journal article about it. Great times, the 60s.

- Did a bunch of other research

- Kept badmouthing Scientology, was labeled an enemy.

- Dennis Clark, former CCHR head and tough guy who appears in some XenuTV videos, "found" the article about the elephant by looking it up at the fucking library. West's reaction was: "Yeah that was me, LOL."

- Assisted Wollersheim's court case as an expert on cult techniques and Scientology in particular.

- As part of the fair game operations, Scientologists such as Steven Fishman were told to call him in the middle of the night to threaten and scream at him. But you should never do that to a Scientology org staff, because that would be cyber-terrorism.
