I certainly hope the gummint handle the video responsibly. Since the state is not a party in this particular dispute, I would expect them to do so (having no apparent incentive to do otherwise), but I'd still feel a whole lot better about it if you'd been able to make a copy before they took it -- or even if they'd been willing to make a copy for you right there before leaving with the original.

Anyways, so are we sure this is a scientologist? She certainly sounds like one but I saw some people saying we don't know yet. Is there something I'm missing here? I don't see why anyone would react like that unless they're a scientologist.

Oh hey, I missed that part.

Learning from you, and despising tinfoil in any form, I refuse to label this person a scientologist until we are sure. While it's certainly very probable, she didn't tell us that she was and we still don't know who she is.

My own theories of probability are these:

1. She's a scientologist.
2. She's connected in some way to scientology but not a 'scientologist' (go where you want with that one, i've gone there too)
3. She's absolutely crazy and happened to fall upon Scientology's standard responses to us.

All sensible possibilities. And you're right that you want to be certain she's a sicentologist. But remember that nobody out there really cares much about scientology. Most people think it's just a silly little UFO cult. So it is rather unlikely that someone who is not a scientologist would react with such emotion and hostility. Although i guess it's possible that a good friend or loved one of her's is a scientologist. Still, based upon what we know I would argue that she is most likely a scientologist.

Hey guys, I just spoken with a lawyer and the police. Here's what I've learned. It's a fair amount, so it'll likely come to you in a few updates.

Legal eagle talk:

One of the next important legal steps is the assault charge will be classified as either a Summary offense or Indictable offense. An indictable offense on assault charges is typically reserved for cases of severe injury and the like. This case is almost guaranteed to be summary, according to my lawfag this means if there is a trial it will likely not be by jury.

The defense will receive their package from the crown prosecutor before any hearing, which will be a 'take plea day' as she was released on her own recognisance (which means she is responsible for herself without there being any bail).

In this package will be anything of my identity that the officer wrote down in his report on that day.

I then asked about making some kind of motion to protect my identity at the trial...

So I asked about concealing my identity, talked about the following and the pattern of behavior internationally about this. And I was basically shut down out of hand.

Not realistic, not gonna happen. "The burden of proof is very high in cases where the victim's identity is withheld, it's for rape trials and stuff like that. People have to have to reveal their identity in trials where they're testifying against the hell's angles. You'd have to prove there is an immediate threat to you."

"But the evidence is solid, this is a simple case and they have independent witnesses. They don't need to know who I am, she assaulted a person." I said.

"It doesn't work that way, the defense has to be able to know who is accusing them of this and who the victim is so that they can look at your record. If you turned out to be someone with fifty assault convictions and a reputation for starting fights downtown, well that would be a pretty plausible defense wouldn't it?"

Dammit. I don't have any kind of record, juvenile or otherwise.... but really there is nothing that can be done. "It's a shot in the dark."

To say the least. When I asked how long until the defense would get this package with my identity in it, I was told "Well, they can't go forward with anything until the defense has had time to evaluate it."

And yes, I'll admit it.... I asked. I'm not going to bother defending why I asked.

"No, it's in the crown's hands now. It's up to the prosecutor."

You should still raise your concerns and say why you have those concerns. Just for the possibility of of anonymity being accepted and for the certainty of it going on record, along with your reasons.

Then IF you get any crap off OSA they won't have a leg to stand on.

One more thing about the legal talk:

I was told that because the assault charge is happening and of where it happened, if I start getting harassed then it will be "very easy to deal with."

The Cops:

I spoke to the officer in charge of the investigation, (whose name I'm not going to be the one to release) whom I had a great conversation with. He assured me that he's going to protect my identity for as long as he can.

I told him about the incident with the blue van, and while of course he was skeptical at first when I told him the whole story and that there were two other witnesses... I said "I mean, the guy could have been lost. I have to grant that, but considering everything... we were pretty creeped out."

"I can imagine."

I also told him about the pattern of behavior with other protesters being stalked, and he told me to call him immediately if it happens again and that it's good I told him. He said that it would be "some time, not immediately." before the defense would receive the package with my identity.

I told him I was reconsidering the idea of the restraining order given the circumstance, but "Is that a little more complicated to do now that it's after the fact?"

"A little, but if you feel it's necessary then we can do it no problem. Her court date isn't until November 10th, that's when she pleads guilty or not guilty. So it'll be a little while before she even knows who you are."
