Brock Turner's actual booking photo from the night of his arrest | Boing Boing

Earlier today, the Santa Clara Sheriff's department released its mugshot of Brock Turner. Here, though, is the booking photo taken the night of this arrest and sent to us by Stanford University's Department of Public Safety, the arresting agency.

Brock Turner, 20, was taken into custody after raping a woman behind a dumpster on Stanford's Palo Alto campus on on January 18, 2015. Though convicted on multiple felony counts, with prosecutors asking for a 6-year custodial sentence, Turner was given only 6 months in jail. With good behavior, he could be out in weeks.

The lenient sentence (he will also spend 3 years on probation and must enroll on the sex offenders' registry) drew much criticism, as did authorities' apparent refusal to release booking photographs of Turner until today. Without access to the public record, most outlets (including Boing Boing) ran a yearbook photo that presented a clean-cut, smiling athlete.

Photographs can influence the public's appreciation of a case, and many criticize police and the media when poor or minority suspects are presented with booking photos, while suspects like Turner end up given the benefit of professional headshots.

Fuck this piece of shit. I want 20 minutes of action with him and a baseball bat. Then I'd give his dad an hour for being an even bigger piece of shit. I don't hope that those six months in jail are the worst months of his life, I hope that they're just the beginning of the lifetime of suffering he endures as karma for what he did to this woman.

  13. I read most of the victims statement and was angry about her having to defend herself in such an obvious case. I found it outrageous to read the statement of the father.
But after reading some comments of internet lawyers calling for secondary crimes (raping or killing him), I think maybe the judge was right.
It does not help anybody to destroy another life - "eye for eye, tooth for tooth ..."? The time in prison is debatable (I think it is too short). A real punishment for the asshole _and_ help for the victim would be if he pays to the end of his life for her - if she agrees.

Would Turner Sr. think the sentence " a steep price to pay " if the victim had been his daughter?
Probably not, I rather think he'd be baying for the blood of the rapist instead.

Stanford Rapist: Special Jail Protection To Prevent Inmate Beatdown | TMZ

Brock Allen Turner, the ex-Stanford swimmer convicted of rape, has been placed in protective custody while serving his sentence at Santa Clara County Jail, to keep him safe from inmates who might harm him.

We spoke to a rep for the Santa Clara County Sheriff's Office, who confirmed to TMZ Sports, Turner is being held in an area away from the general inmate population, and will have a deputy escort whenever he moves around the grounds.

He will be exposed to other inmates, but only ones in "protective custody", which include people convicted of sexual assault, LGBT inmates and gang dropouts.

"They're kept totally separate ... so they aren't harmed."

We're told Turner's "protective custody" status is NOT due to the fact his case is so high-profile, but rather because he was convicted of sexual assault, and those type of inmates are often targeted.

Judge Aaron Persky sentenced Turner to 6 months in county jail for raping a 23-year-old woman on the Stanford campus in 2015, but with good behavior he could be out by September.

Stanford rapist Brock Turner: “I've been shattered by the party culture”

    By Xeni Jardin, Boing Boing

    Quote:

In a pre-sentencing letter to the judge released today by the New York Times, convicted rapist Brock Turner fails to own any responsibility for raping an unconscious woman behind a trash dumpster on Jan. 17, 2015. Turner's plea letter reads like a laundry list of white male privilege lost. It touched the white male judge in all the right places. Turner begs for leniency in his letter, and he got it.

“I’ve been shattered by the party culture and risk taking behavior that I briefly experienced in my four months at school,” writes the former Stanford University student. “I’ve lost my chance to swim in the Olympics.”

Turner blames the sexual assault he committed on a campus culture of excessive alcohol consumption, peer pressure, and “sexual promiscuity.”

There's no way Brock Allan Turner -- oh by the way, did you see his swimming times? -- could have raped a woman because he's a fucking rapist.

In a letter to Judge Aaron Persky of the Santa Clara County Superior Court which was submitted before his ridiculously wrist-slap of a sentence, Turner says: “I am the sole proprietor of what happened on the night that changed these people’s lives forever. I would give anything to change what happened.”

The New York Times published a copy of his letter today. In it, Turner also says that his decision to rape an unconscious woman behind a trash dumpster on the Stanford campus left him “a changed person.” I'll bet! It changed the woman he raped, too.

Here, let Brock Turner tell you more about what he has lost by raping that anonymous woman.

“I’ve lost my ability to obtain a Stanford degree. I’ve lost employment opportunities, my reputation and most of all, my life.”

That's right. Because he raped an unconscious woman behind a dumpster, he literally lost his life.

“These things force me to never want to put myself in a position where I have to sacrifice everything,” the rapist continued.

“I would make it my life’s mission to show everyone that I can contribute and be a positive influence on society from these events that have transpired. I will never put myself through an event where it will give someone the ability to question whether I really can be a betterment to society. I want no one, male or female, to have to experience the destructive consequences of making decisions while under the influence of alcohol. I want to be a voice of reason in a time where people’s attitudes and preconceived notions about partying and drinking have already been established.”

What is the moral of Brock Turner's rape-to-redemption story?

“I want to let young people know, as I did not, that things can go from fun to ruined in just one evening.”

In addition to his six-month jail sentence, which is insanely lenient compared to the 14-year maximum, Turner will serve three years’ probation and must register as a sex offender.

Get your tiniest violin ready to play the saddest song in the universe, because he also lost his swimming scholarship to Stanford, and the university banned him from ever stepping foot on the campus again.

That punishment was "a steep price to pay for 20 minutes of action," according to Brock Turner's dad.

Want to get even more pissed off? Stanford had one rape every two weeks before Brock Turner was caught on Jan. 17, 2015.

Scathing Letter to Father of Stanford Sex Offender Brock Turner Goes Viral

    • By MORGAN WINSOR
    Jun 9, 2016, 1:48 PM ET

Dan Turner’s words outraged many people across the nation, including John Pavlovitz, a pastor, blogger and father in Wake Forest, North Carolina. In a blog post titled “To Brock Turner’s Father, From Another Father,” Pavlovitz writes that “there is no scenario where your son should be the sympathetic figure here.”

“I need you to understand something, and I say this as a father who dearly loves my son as much as you must love yours. Brock is not the victim here. His victim is the victim. She is the wounded one. He is the damager,” Pavlovitz wrote in the blog post. “This young woman will be dealing with this for far longer than the embarrassingly short six months your son is being penalized. She will endure the unthinkable trauma of his ‘20 minutes of action’ for the duration of her lifetime, and the fact that you seem unaware of this fact is exactly why we have a problem.”

His blog has been flooded with readers. Pavlovitz wrote on Twitter on Wednesday that the “site is overwhelmed” and asked visitors to “keep refreshing if you get errors.”

In a statement issued Tuesday to CNN, Dan Turner said people had misinterpreted the phrase "20 minutes of action." "What I meant with that comment is a 20-minute period of time. I was not referring to sexual activity by the word 'action.' It was an unfortunate choice of words, and I did not mean to be disrespectful or offensive to anyone," Dan Turner said.

He could not be immediately reached by ABC News for comment in response to Pavlovitz's letter.
Pavlovitz said he doesn’t think Brock Turner is a “monster” but believes he still must face the consequences because “he acted like one.”

“Brock has to register as a sex offender because he sexually assaulted an incapacitated young woman. This is why we have such requirements; because one vile act against another human being is one too many,” he wrote. “It feels like you want more sympathy and goodwill toward your son than you want for the survivor of his crime, and that’s simply not good enough for her or for those young men and women watching.”

Vice-President Joe Biden's Open Letter to Stanford's Amazing Victim

An Open Letter to a Courageous Young Woman
"I do not know your name — but your words are forever seared on my soul. Words that should be required reading for men and women of all ages.

Words that I wish with all of my heart you never had to write. I am in awe of your courage for speaking out — for so clearly naming the wrongs that were done to you and so passionately asserting your equal claim to human dignity.

And I am filled with furious anger — both that this happened to you and that our culture is still so broken that you were ever put in the position of defending your own worth. It must have been wrenching — to relive what he did to you all over again. But you did it anyway, in the hope that your strength might prevent this crime from happening to someone else. Your bravery is breathtaking.

You are a warrior — with a solid steel spine. I do not know your name — but I know that a lot of people failed you that terrible January night and in the months that followed.

Anyone at that party who saw that you were incapacitated yet looked the other way and did not offer assistance.
Anyone who dismissed what happened to you as “just another crazy night.”Anyone who asked “what did you expect would happen when you drank that much?” or thought you must have brought it on yourself. You were failed by a culture on our college campuses where one in five women is sexually assaulted — year after year after year. A culture that promotes passivity. That encourages young men and women on campuses to simply turn a blind eye. The statistics on college sexual assault haven’t gone down in the past two decades. It’s obscene, and it’s a failure that lies at all our feet.

And you were failed by anyone who dared to question this one clear and simple truth: Sex without consent is rape. Period. It is a crime.

I do not know your name — but thanks to you, I know that heroes ride bicycles. Those two men who saw what was happening to you — who took it upon themselves to step in — they did what they instinctually knew to be
They did not say “It’s none of my business.” They did not worry about the social or safety implications of intervening, or about what their peers might think. Those two men epitomize what it means to be a responsible bystander. To do otherwise — to see an assault about to take place and do nothing to intervene — makes you part of the problem. Like I tell college students all over this country — it’s on us. All of us. We all have a responsibility to stop the scourge of violence against women once and for all.

I do not know your name — but I see your unconquerable spirit. I see the limitless potential of an incredibly talented young woman — full of possibility. I see the shoulders on which our dreams for the future rest.

    I see you.

You will never be defined by what the defendant’s father callously termed “20 minutes of action.”

    His son will be.

I join your global chorus of supporters, because we can never say enough to survivors: I believe you. It is not your fault. What you endured is never, never, never, NEVER a woman’s fault.

And while the justice system has spoken in your particular case, the nation is not satisfied. And that is why we will continue to speak out.

We will speak to change the culture on our college campuses — a culture that continues to ask the wrong questions: What were you wearing? Why were you there? What did you say? How much did you drink?
Instead of asking: Why did he think he had license to rape?

We will speak out against those who seek to engage in plausible deniability. Those who know that this is happening, but don’t want to get involved. Who believe that this ugly crime is “complicated.”

We will speak of you — you who remain anonymous not only to protect your identity, but because you so eloquently represent “every woman.”

We will make lighthouses of ourselves, as you did — and shine.

Your story has already changed lives. You have helped change the culture. You have shaken untold thousands out of the torpor and indifference towards sexual violence that allows this problem to continue. Your words will help people you have never met and never will. You have given them the strength they need to fight. And so, I believe, you will save lives.

I do not know your name — but I will never forget you. The millions who have been touched by your story will never forget you.

And if everyone who shared your letter on social media, or who had a private conversation in their own homes with their daughters and sons, draws upon the passion, the outrage, and the commitment they feel right now the next time there is a choice between intervening and walking away — then I believe you will have helped to change the world for the better."

Brock Turner's claims to judge contradicted in new documents | LA Times

Judge Aaron Persky said he took Brock Turner “at his word” last week when he sentenced the onetime Stanford University swimming star on charges that he sexually assaulted a woman on campus.

Turner said he thought he was having consensual sex with the victim, even though she was unconscious when he was caught on top of her behind a dumpster.

Judge Persky also seemed to believe the larger narrative Turner put forward during that trial: A 19-year-old freshman from small-town Ohio, naive about drinking and partying, looked to his swim teammates for guidance in a wild new social realm and made one quick bad decision.

But 471 pages of documents released by the Santa Clara County Superior Court show Turner lied about never using drugs and not drinking before college. And they depict Turner as not simply making a bad choice, but having a penchant of making aggressive, unwanted advances on women; at the frat party where he met the victim, he kept forcing kisses on the victim’s younger sister as she “wiggled out of his hold.” At a party a week before, he “creeped out” a woman he tried to grab.

Prosecutors, who were asking for a sentence of six years in prison at the hearing last Thursday, wrote that his “behavior is not typical assaultive behavior that you find on campus, but it is more akin to a predator who is searching for prey.”

Apparently unswayed, Persky sentenced Turner to what will probably amount to three months in jail, and promptly found himself in a firestorm of outrage.

A Stanford law professor has launched an effort to recall Persky, and nearly a million people have signed an online petition calling on the California Commission for Judicial Performance to remove him.

Movement To Recall Stanford Rape Judge Aaron Persky Adds Three New Consultants | Inquisitr

Public outcry in the Stanford rape case has already sparked the creation of several petitions for an impeachment hearing against the judge who handed down a sentence of only six months in jail. While the success of those petitions are the result of a grassroots movement by everyday citizens, the Recall Judge Aaron Persky campaign is amping up their protest by adding three professional political consultants to their team to keep the signatures coming in and get the votes needed to send Persky packing.

Media consultant Joe Trippi, pollster Paul Maslin, and campaign strategist John Shallman boast impressive resumes, including Trippi’s previous work for Democratic presidential candidates, Maslin’s work with California Gov. Jerry Brown and members of Congress, and Shallman’s previous work with the California Senate on the “yes means yes” law in California, requiring college campuses to address the issues regarding consent on campuses.

After the conviction of former Stanford University swimmer Brock Turner, the sentencing and the remarks made by Judge Persky in his ruling have prompted over 1 million signatures on a Change.org petition and another 200,000 on a MoveOn.org petition calling for his removal from the bench, according to Vanity Fair. A White House petition has exceeded the 100,000 signatures required to prompt a response from the Oval Office, as well.

Remember Brock Turner? From 3 Months Ago? He'll Leave Jail On Friday.

    Excerpt:

Over one million people signed a petition calling for Santa Clara County Superior Court Judge Aaron Persky ― who presided over Turner’s case ― to be removed from the bench over the lenient sentence. Activists and celebrities held fundraisers to galvanize the public to support their efforts. In August, Persky finally quit criminal court and will now only preside over civil court trials.

In response to Persky’s light sentence, California lawmakers recently passed legislation that would make jail time mandatory in cases like Turner’s. Under the provisions of this new legislation, Turner would have faced a minimum of three years in jail.

Ex-Stanford swimmer leaves jail after serving half his term | Associated Press

    Excerpt:

California jail inmates with good behavior typically serve half their sentences. Ohio prison officials earlier this month agreed to take over supervision of Turner's probation.

Greene County Sheriff Gene Fischer said Turner has five days to register as a sex offender with his office in Xenia, Ohio, 15 miles east of Dayton. He will have to report to a probation officer for three years and must avoid alcohol and drugs during that time.

Fischer said his department will send postcards to Turner's neighbors informing them that a convicted sex offender is moving in nearby. Turner will be required to register every three months in person at the sheriff's office, reaffirming that he is still living with his parents, the sheriff said.

Deputies also will check on Turner periodically and without warning to ensure he has not moved out without permission from authorities.

Turner also is barred from parks, schools and other places where children are expected to gather.

"He will be treated no differently than any other sex offender we monitor," Fischer said.

Judge in Stanford sexual assault case offers first defense of his decision | Associated Press

    Quote:

A judge who is facing a recall effort over the sexual-assault sentence he gave a former Stanford University swimmer is publicly defending himself for the first time, saying that it's his job to consider lighter sentences for first offenders and that he cannot allow public opinion to factor in his decisions.

“California law requires every judge to consider rehabilitation and probation for first-time offenders,” Superior Court Judge Aaron Persky wrote in the statement filed with the Santa Clara County Registrar of Voters.

The statement makes no direct reference to Brock Turner. The six-month sentence Persky gave Turner last year spurred outrage and brought on the recall effort.

It cites a review of Persky's rulings by the Associated Press that found that he followed the recommendations of the parole board in every similar case, suggesting that Turner did not receive special treatment for his status as a white collegiate athlete, as many critics have suggested.

“As a judge, my role is to consider both sides,” Persky says in the statement. “It's not always popular, but it's the law and I took an oath to follow it without regard to public opinion or my opinions as a former prosecutor.” Persky adds that he “fought vigorously for victims” when he was a prosecutor.

If approved by the county, Persky's statement will appear on the petitions for his recall, along with a statement filed by his opponents.

Those opponents, a group led by Stanford University law professor Michele Dauber, filed paperwork Monday with the registrar in the first formal step toward removing Persky.

The group will have 160 days to gather the nearly 59,000 signatures of registered voters needed to qualify the measure for the ballot next year.

Turner could have faced up to 14 years behind bars for sexually assaulting the woman who had passed out behind a trash bin near a fraternity house.

Brock Turner, convicted of sexual assault, asks for new trial | CNN

    Quote:

The former Stanford University swimmer who was convicted last year of sexually assaulting an unconscious woman -- and spent only three months in jail -- is appealing his convictions and requesting a new trial.

Lawyers for Brock Turner filed an appeal Friday with California's 6th District Court of Appeal, claiming their client was denied due process during his 2016 trial and calling it "fundamentally unfair."

Turner was charged after two Stanford graduate students witnessed the assault taking place in January 2015 while they were riding bicycles near Stanford. He was 19 at the time.

A jury in Santa Clara County found Turner guilty in March 2016 on three felony counts: assault with intent to commit rape of an intoxicated or unconscious person, penetration of an intoxicated person and penetration of an unconscious person.

Key to Turner's request for a new trial is a statement the prosecutor repeatedly made during trial, saying the assault occurred "behind the dumpster."

The assault, Turner's lawyers argue, did not occur "behind the dumpster." Indeed, the victim was found in a "completely open setting," the appeal states, adding that the implication that the crime occurred "behind the dumpster" prejudiced the jury against Turner.

That characterization of the crime, "implied an intent on the appellant's part to shield and sequester his activities" and "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently associated with dumpsters," the document states.

The appeal also claims Turner was denied a fair trial because witnesses who would testify to his good character were excluded by the court. It also claims the prosecution failed "to present constitutionally sufficient evidence" to support the three counts of conviction.

Turner's lawyer, Eric Multhaup, said he had nothing to add about "the unfairness of the conviction" beyond the court filing.

"What we are saying is that what happened is not a crime," John Tompkins, Turner's legal adviser, told KNTV. "It happened, but it was not anywhere close to a crime."

Turner's trial was thrown into the national spotlight after the victim's wrenching impact statement went viral, then again when Superior Court Judge Aaron Persky gave Turner to a six-month jail sentence, prompting an outcry from critics who said the punishment was too lenient. As a result of the backlash, Persky -- at his own request -- no longer hears criminal cases.

Turner was released for good behavior after serving just half the sentence imposed. As part of his sentence, Turner must register for life as a sex offender.

  42. Please give him a new trial, it's doubtful he will find another enabling judge especially when his lawyers say it wasn't a crime.

Voters oust judge who gave Brock Turner 6 months for sex assault | CNN

    Quote:

Two years after Judge Aaron Persky sentenced a Stanford athlete to six months for sexual assault, voters in California delivered their own verdict by booting him from office.

With 100% of Santa Clara County precincts reporting, 60% of voters said Persky should be removed from the bench. About 40% said he should keep his job.

...once the election is certified, Persky will no longer be a judge. This marks the first time since 1932 that California voters have recalled a sitting judge.
