Just spoke with the legal department over at the Electronic Frontier Foundation. They are actively investigating the recent fraudulent takedowns of our videos and any connection between oschaper and American Rights Councel LLC.

Anyone with evidence connecting oschaper to American Rights Councel LLC and/or had videos taken down recently by fraudulent copyright claims by American Rights Councel LLC, Media House Enterprises, The Schaper Company, Dr. Oliver Schaper or any other oschaper front, should send that information to the EFF legal department immediately.

In other words they want a link to the video that was fraudulently removed, when it happened (you should have an email from YT that says as much), who made the fraudulent claim, if you own the copyright, if not why you feel you have a right to use the material in the first place. You should also make a note if for instance you have a video in a series of 3 that was claimed by Media House and another in the same series that was claimed by ARC LLC. This helps make a link between oschaper and ARC LLC. Also send them any evidence you have of harassment or threats by oschaper against you immediately before this wave of fake DMCA claims.

The link to Oschaper and ARC might be hard to prove; however, EFF can definitely go after ARC and get whatever info YT was given by them to prove they exist--surely there has to be email, adddress etc. if not--what kind of accountability does YT have/offer?

I deleted all the old versions of my videos beacuse I had uploaded new versions, however they had all been reinstated anyway so they would not have shown who they were taken down by. Shit, I never thought to keep them. I bet YouTube will have records though....and I MIGHT STILL HAVE THE EMAILS NOTIFYING ME OF THE REMOVALS!!!

ARC is pretty simple, IMHO. There's no record of them on teh internets outside of the news stories that carry their name and attach it to the DMCA-fagging... which is around 100 or so hits on my last search on two major search engines.

In other words, this failboat of a company doesn't exist, and is therefore an epic failboat.

I just hope it IS OSchapper and not some channers havin fun with the YouTube first, then DDoSing Enturb because of the lulz/internet hate macharliesheen/discredit. 4000 vids is quite a feat to do alone, and Oliver doesn't seem bright enough to do a script et al, and besides that, how would it hit specific vids etc unless he was building a database? Maybe he has been.

Okay, I sent what I had. FOUR removal notfications (I'm certain I have not deleted any, but I KNOW there were more videos removed.) Not a good sampling either, two were my Oschaper vids, removed by his company names, and two were news reports, removed by American Rights Counsel, LLC, but I am CERTAIN I had the news reports pulled by Schaper's company names at one point. Anyway, I am not too worried since other Anons will be adding their stuff, plus I would assume that YT have records of all videos that were removed from my account so I have given EFF permission to go after that information.

I'm sure someone said they had a couple of videos removed due to claims by 'Oliver Schaper', in fact it might have been me, but nothing in my email box......ARGH!

I have also stressed that the OSA more than likely had a hand in the ARC LLC takedown, or were entirely responsible.

Actually, I just had another idea.

Is it possible that this WAS an OSA op (as many have suggested becuase of the increased publicity from the anti-Sci conference) but that it was just poorly timed and accidentally coincided with oschaper's vendetta? That OSA were unaware of what was going on when they launched their attack? Think about it, the only reason the ARC LLC one got resolved almost instantly was because we were already kicking up a stink about Oschaper's takedowns....

Whatever, I would put money on Ollie having had a severe ticking off from OSA for going off half cocked, and I bet that even if he had nothing to do with ARC LLC, they will pin it on him entirely because of the media attention, he's a convenient scapegoat.

The EFF first broke the story regarding the requests. YouTube received the notice all at once, in a single request. When Wikinews asked the EFF if they knew the names or links to the material in question, they stated that they do not know the names and that they have not seen the notice filed with YouTube.


I dunno, this smells of CoS/OSA trying to pull a 'Do it or we'll sue you', ie a straight takeover.

That had to have been OSA, not Ollie. Because that was a mistake. That meant that the moment we started to send DMCA counter-claims, the whole takedown was invalidated and all the videos had to be put back up. Stupid, stupid OSA.

Okay, that explains the ARC takedowns. We already know that Ollie was doing his own. What about the other two false fronts? Was that their Plan B? Were those takedown notices filed individually or collectively like ARC?

As I said in another thread, I think that OSA timed this well, and Ollie fit right into their plans, because Ollie was an easy patsy to throw at Anon for Anon to waste its efforts on. Apparently, they haven't realized that Anon can multitask. It didn't matter whether the assault was coming from Ollie or from OSA; Anon was going to take care of it. And we did it in such a way that OSA won't ever try doing this again. We now know our way around the DMCA counter-claim system and know how to use it and keep Anon safe. We now know that YouTube is going to get really, really suspicious of any and all takedowns on anti-Scientology material. And by using the DMCA the way they did, they gained us a new ally in EFF. And they have real lawyers and a sterling reputation.

When WBM was taken down the first time, it took us sixteen days to get him back up. When we got taken down by this wave, it took us sixteen hours to get back up. Next time, it'll take sixteen minutes.

Got a response back from EFF already, it stank of 'generic reply' or 'didn't really read what you had to say', anyway I answered their follow up questions. They asked for links to my videos that are up, I'm shitting bricks now in case I get a bollocking for the tone and content of my 'Oschaper' vid. In my defense, he was well within his rights to request its removal based on the fact it had his name, photo etc (YT has a policy where you can request a video's removal if it features personal information about you etc), BUT he didn't go that route, he went copyright infringement, which is bollocks because I made the video. UMG made a claim on the original version featuring the Beck track, but even they had said it could stay up as long as they got an advert above it.....

If it was one with one notice, IMO that reeks of OSA--assigning some staff to find as many videos as they could, compiling a list and then sending them with one notice.

Was Ollie a coincidence? Did OSA know his tussles with Housespider et al? Prolly. Did they care? NO. Collateral damage in an attack which was to remove as many Anon videos as possible. Maybe the plan was to take down >9000 and Schaper got in the way, maybe he was an OSA attempt at legerdemain.

Will OSchaper have to buy a bunch of courses and auditing to make up for it to Sci? Yeah. Even if he was clueless to what The Big Plan was (in OSA's mind) this is now "another fine mess you've gotten us into Ollie."

Either way, massive failure on the joint takedown notice. If they were relying on none of the anons being able to file counter-notices, they shouldn't have included WBM. That was stupid on a level that only OSA seems capable of.

I'd guess added on after the huge notice, maybe OSA got trigger happy. And then youtube just reinstated ALL the videos because they all came from the same claimants, or possibly the same IP if youtube has that info and was cross-checking.

OSA was probably monitoring those accounts to see that the videos were indeed taken down. Then they found more videos that offended their sensibilities and added them to the list. At one point, they probably got a little antsy about putting everything in the ARC basket and started using the other two front companies.

I know for a fact that they were doing searches during the takedown to see if other accounts had those videos. Otherwise, how would they have known about an account that I'd created only hours earlier putting up the Today Tonight video? They had to have had a list of specific videos to target, assuming that Anon would create new accounts to upload them to. What they didn't know was that at least one of those accounts was created specifically to file DMCA counter-claims.

You know, I think I've figured something out: as I said, they were monitoring the accounts initially targeted. When they saw that this was working, they got daring and included people like WBM in supplementary notices. Since it was working so well, they probably thought that we'd have to spend a couple of weeks sifting through the wreckage like we did the last time WBM's account was nuked.

They miscalculated severely, in a number of areas. And it cost them YouTube as a weapon, probably forever.

I had written a post that expanded on a point that Empress had brought up, about certain motivations (specifically that I think that OSA's actions were ordered by DM, and that Ollie is their ultimate fall guy to pass the blame onto), but it turned out so tl;dr that I killed it.

The events of the takedown are now very clear, and anything that I've written about it is simply based on the evidence and what we know about how OSA works. I'm trying not to make stuff that I write sound like a J. Swift thing, because we need to learn from this event. We can't sit on this win and then flail around like a bunch of idiots the next time; we have to use this experience to refine our tactics and counteract anything they can come up with.

Don't be surprised that it's difficult (read: impossible unless under court order) to get the IPs of the bogus DMCA claimant(s).

That's NORMAL. In ANY situation.

No provider, anywhere, will merrily give out the IP addresses of "offenders" unless it's done under court order. I.E., no subpoena, no info. Okay, there have been a few incidents were providers have given up IPs without a court order... but these are few and far between.

Any legal department worth its salt will withhold info like this until they're forced to give it up by a court... thus avoiding being sued into oblivion. Even if they WANT to give the info away, they're going to hang onto it until ordered to turn it over by a judge. That's just how these things work. I've been in the position of WANTING to turn over info like this... but constrained by my company's legal department from doing so.

What we need to do is to arm someone like the EFF with enough evidence to convince a judge that a crime has been committed... and that it's in the interest of justice to issue a subpoena for more info. Unless you can show substantial monetary damage, the feds themselves are almost useless when it comes to sparking an investigation. Folks like the EFF are golden in situations like these where the damage is intangible.

If you got screwed in the latest round of YouTube fuckery... please send email to the EFF rep in the OP. They have smart lawyers with (seriously) pointy teeth. I sure as fuck wouldn't want them on my ass.

As a business, I imagine it's in YouTube/Google's best interest to just ignore this annoyance and move on quickly unless it's a repetitive time waster for them. This, being the second round of BS they've gone through re: CoS-critical videos is probably on the edge of something they think they need to address.

Perhaps they'd like to make an example out of the person responsible for this huge abuse of the DMCA? Help 'em do that. If I were a Google exec right now, I'd actually be happy to hear the EFF wanted a piece of the action. All it would take is a court order instructing me to hand over the data to EFF attorneys representing those who were wronged.

Under court order, I'd give the EFF the offender's data on a silver platter.

You are quite right. I also noticed something very upsetting that I never thought necessary to mention up till now. Youtube must have put the digital code of the removed clips in their database cos it made it impossible for me to load the same clips to your honeypot account after they had been taken down. Even with new titles.

It's uncertain whether Oschaper is responsible for the ARC LLC takedowns, but I strongly suspect he at least had a hand in it. Consider that he used the exact same methods to attack the exact same targets at the exact same time. He's guilty for sure, just how guilty is the question.

Not quite. They did have digital signatures in their database. But those were for the videos that were taken down due to TOS violations, not DMCA claims. The videos you uploaded to the honeypot account that were nuked for DMCA claims, including the Today Tonight video (which I should have claimed you were responsible for uploading sooner; my apologies), weren't immediately blocked. The DMCA claim had to be received and processed. It wasn't an automatic procedure, I believe. I have no idea how YouTube deals with this, but it took an hour and a half for the Today Tonight video to be DMCAed.

The TOS violation videos, I killed after they were flagged as being such. I didn't want the account taken down due to repeated TOS violations. After I noticed that, I told everyone here to start feeding me videos that were only taken down due to DMCA claims. And that worked, since the honeypot is still active. It's become a Bulletproof and will serve us well.

There is no way to know if Oschaper was involved until he's deposed or questioned on the witness stand, and that can only happen if the victims file criminal or civil charges against the John Does to acquire the Google records -- which will probably yield fictitious, fraudulent contact information for the Scientology criminals who committed the crime, ending at a dead end.

Thing Google will learn anything from this repeated series of attacks against freedom of speech by the Scientology crime syndicate? Their automated systems should be tailored to automatically reject any claim which targets videos covering Scientology's crimes, abuses, or the efforts by activists to destroy the criminal enterprise.

You would think that by now Google would have learned its lesson and would be working with victims to sue the Scientology criminals.

All you need to do (if you didn't already know of course) is repack them with slightly different settings (compression or filetype etc.) and then they will go back up fine.
